SMS/MMS Messaging — Terms & Conditions

These SMS/MMS Messaging Terms and Conditions (the “Agreement”) apply to the mobile messaging program (the “Program”) operated by Noah Reicin d/b/a TableTalk (“TableTalk,” “we,” “us,” or “our”). This Agreement applies solely to the Program and does not modify any other TableTalk terms.
1. Program Overview
The Program sends operational messages only to restaurant staff designated as authorized users. These may include alerts for new orders, reservations, or calls. TableTalk does not send promotional or marketing messages to restaurant customers through this Program.
2. Authorization & Opt-In
Each restaurant must explicitly authorize every mobile number before it receives messages. Authorization may occur through:
- A signed agreement listing authorized numbers.
- An Admin Console opt-in with a clear consent checkbox.
- A verified keyword opt-in (reply “START” after confirmation).
Message and data rates may apply. Consent is not a condition of purchase.
3. Message Frequency
Messages are event-based. Typically, recipients may receive 1–3 messages per call, reservation, or order.
4. Opt-Out Instructions
To stop receiving messages, reply with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.A one-time confirmation will follow.
5. Support
For assistance, reply HELP or email tabletalkai.net@gmail.com. To unsubscribe, text STOP—email requests will not remove you from messaging.
6. Responsibility for Accurate Numbers
You must remove or opt out numbers before reassigning or deactivating them. You agree to indemnify TableTalk for any claims arising from messages sent to numbers you no longer control.
7. Delivery and Carrier Limitations
If MMS is unsupported, messages may be sent via SMS. Delivery depends on carrier performance. Carriers (including T-Mobile) are not responsible for delays or failures.
8. Eligibility
Use is limited to restaurant staff 18 years or older with a compatible device and carrier.
9. Content Restrictions
Do not use the Program for unlawful, harassing, defamatory, obscene, or infringing content. Do not transmit malware or sensitive data (e.g., PHI).
10. Cost
Message and data rates may apply.
11. Disclaimer and Liability
The Program is provided “as is.” TableTalk disclaims all warranties and limits liability to the greater of $100 or the amount paid (if any) for Program access. No consequential or punitive damages apply.
12. Dispute Resolution
Any dispute shall be resolved through binding individual arbitration in San Francisco, CA, under the AAA Commercial Rules. No class actions or jury trials.
13. Updates
We may update these terms from time to time. Changes take effect when posted with a revised “Last updated” date.
