SMS/MMS Mobile Messaging — Terms & Conditions

These Mobile Messaging Terms & Conditions (the “Agreement”) govern the SMS/MMS program (the “Program”) offered by Noah Reicin d/b/a TableTalk (“TableTalk,” “we,” “us,” “our”). This Agreement applies only to the Program and does not modify other site/app terms.

1) Program Scope (Restaurant-Only)

We send operational, event-based texts only to restaurant personnel designated by the restaurant (each an “Authorized Number”), e.g., new call/reservation details, order summaries, updates. We do not send messages to the restaurant’s end-customers through this Program.

2) Opt-In & Authorized Numbers

The restaurant must affirmatively authorize each mobile number before it receives messages, via (i) a signed service agreement/order form with explicit SMS consent listing Authorized Numbers, (ii) an Admin Console flow with a clear consent checkbox, or (iii) keyword double opt-in from a business-owned device (reply “START” after our confirmation). By opting in, you represent you control the Authorized Number and have authority to consent. Msg & data rates may apply. Consent is not a condition of purchase.

3) Frequency

Event-based; typically 1–3 messages per reservation/order/call. Frequency varies with activity.

4) Opt-Out

Text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to opt out. A one-time confirmation may follow. These are the only recognized opt-out methods.

5) Help

Text HELP for help or email tabletalkai.net@gmail.com. (Email is not an opt-out—use STOP.)

6) Duty to Maintain Accurate Numbers

Before reassigning/discontinuing a number, remove it or send STOP. You agree to indemnify us for claims/costs arising from messages sent to numbers you no longer control due to failure to opt out or update.

7) Delivery & MMS

If MMS is unsupported, we may send SMS. Delivery depends on carriers/networks; carriers (including T-Mobile) are not liable for delays or failures.

8) Eligibility & Age

Business use by restaurant personnel 18+ on supported carriers/devices.

9) Prohibited Content

No unlawful/abusive/harassing/defamatory/obscene/hateful/infringing content; no malware; no PHI/HIPAA content; nothing illegal where received.

10) Cost

Msg & data rates may apply.

11) Disclaimers; Limitation of Liability

Program is provided “as is.” We aren’t responsible for delays/failures. To the fullest extent allowed by law, we disclaim all warranties and limit liability to the greater of $100 or amounts paid (if any) for Program access, excluding indirect/special/consequential/punitive damages.

12) Dispute Resolution; Arbitration; Class Waiver

Any dispute relating to this Agreement or the Program will be resolved by binding, individual arbitration in San Francisco, California under the AAA Commercial Rules and the FAA. No class actions or class arbitration. Parties waive jury trial. This section survives termination.

13) Changes

We may modify/suspend the Program or these terms. Changes are effective when posted with the updated “Last updated” date.
